The Lawyer in the Dutch Interrogation Room: Influence on Police and Suspect

چکیده
In many European countries, providing a suspect in custody with legal aid before the first police interrogation is a heavily debated issue. In this paper, we report on an exploratory study on the use of coercion by the police and the use of the right to silence by suspects in 70 Dutch homicide cases and their relation to prior consultation and presence of a lawyer. Analysis of the data indicates that there is a relation between the presence of a lawyer in the interrogation room and the way in which police interrogators use coercion. To gain insight into whether the police use coercion and how this is achieved, we looked at the extent to which the interrogators make use of certain interrogation techniques and how the interrogation techniques are used to exert coercion. We found that legal advice from a lawyer before and during the interrogation corresponds with suspects more often using their right to silence. It also appears that the police are inclined to use ‘hard coercion’ when confronted with a silent suspect. The research thus raises the question as to whether the presence of a lawyer is an adequate way to prevent false confessions. Copyright © 2012 John Wiley &

Police-induced confessions: risk factors and recommendations.
Recent DNA exonerations have shed light on the problem that people sometimes confess to crimes they did not commit. Drawing on police practices, laws concerning the admissibility of confession evidence, core principles of psychology, and forensic studies involving multiple methodologies, this White Paper summarizes what is known about police-induced confessions. In this review, we identify susp...
متن کاملA Virtual Suspect Agent’s Response Model
We develop a computational interpersonal affective response model for virtual characters that act as suspect in a serious game for training interviewing (interrogation) skills to police officers. We implemented a model that calculates the responses of the virtual suspect based on theory and observation. We describe the aspects of the move (question asked) by the police interviewer that we disti...
متن کاملFalse Confessions: Causes, Consequences, and Implications for Reform
Despite the commonsense belief that people do not confess to crimes they did not commit, 20 to 25% of all DNA exonerations involve innocent prisoners who confessed. After distinguishing between voluntary, compliant, and internalized false confessions, this article suggests that a sequence of three processes is responsible for false confessions and their adverse consequences. First, police somet...
متن کاملInvestigative Interviewing for the Purposes of Gathering Intelligence Unchartered Waters : Social Science in Intelligence Interviewing Contexts
Contrary to the harsh ‘enhanced interrogation’ techniques employed during CIA operations on the War on Terror, contemporary research demonstrates that rapport building is a more effective way of achieving positive outcomes in interviews with general offender populations. Comparatively less research has explored the role of rapport with recalcitrant suspects, particularly suspected terrorists. W...
متن کاملModelling Interpersonal Stance in Affective Conversations in Police Interrogations
Building believable conversational virtual characters that can play the role of a suspect in police interrogations requires a lot of information on human behaviour. In this paper, we try to describe the way in which the stance of a suspect in a police interrogation changes and is decided. We base our stance modelling on Leary’s interpersonal stance theory and add influences from social attitude...
